Terms of Service

By paying the down payment of your costume you are agreeing to all of Bear Macabre Studio's terms and regulations.

Requirements 

  • Anyone under the age of 18 must provide parental consent from a legal parent or guardian.

  • Anyone over the age of 18 must provide proof that they are a legal adult.

  • A clear reference sheet with at least two views is required. If you can't provide me with an accurate reference sheet, I am not responsible for any errors in designs.

  • You must be financially stable at the time of commissioning me.

  • Fullsuits, 3/4 suits, full partials, or feetpaws require a duct tape dummy and/or a pair of unused shoes.

Payment

  • I only accept payment through Square. If you have commissioned me before, I will accept USD through snail mail.

  • All payments are made through invoice only. Payments made without an invoice are considered a tip and are non-refundable. 

  • Payment plans are only accepted on orders of over $350. 

  • I require a 45% non-refundable down payment on all payment plans which is used to pay for materials.

  • Shipping costs of must be covered by the buyer.

  • Failing to pay multiple payments on time without any communication will result in work being paused and you will be moved to the bottom of my queue. 

  • When paying in installments, additional fees will be charges to cover the losses from Square's fees.

  • If I am unable to work on a commission any longer I will issue a full refund to the buyer which includes transaction fees and money that has been spent on materials.

  • When you pay the down payment, you are agreeing that you are financially stable and that you will consistently pay the agreed upon amount on the agreed upon date. Failure to do so may result in being unable to pay in installments on a future order or, depending on the severity, a permanent black list.

Cancellation 

  • 45% of the buyer's commission can not be refunded if they chose to cancel even if materials have not yet been ordered.

  • 50% of the buyer's commission can not be refunded if they chose to cancel after I have started work, but am not yet halfway complete.

  • 65% of the buyer's commission can not be refunded if they chose to cancel after I have started and am halfway completed or more, but not finished.

  • 90% of the buyer's commission can not be refunded if they chose to cancel after I have completed the commission, but have not shipped it.

  • You can not issue any type of refund after your commission has been shipped. I show multiple stages of your commission throughout the entire commission process so you know what you are receiving. If there are holes or damage to your commission, it can usually be sent back and fixed as long are you have not voided the warranty. 

  • If you cancel your commission after it is completed or almost completed, design modifications will not be made and it will be sold as-is if it was a small part commission(Ex. handpaws, tails) or artistic liberty commission.

What Will Result In A Blacklist

  • Character theft. If the suit is in the process of being made or has been finished, but not mailed, the buyer will receive NO REFUND and it will be given to the character's true owner or the design will be changed and sold as a premade.

  • Sending explicit or sexual content. Reference sheets may have explicit content, but is must be censored!

  • Any type of harassment(warnings will be given).

  • Asking up updates every day.

  • Lying about your age.

  • Failing to read or follow my terms of service.

  • Filing for a refund after your costume has shipped and you have received it. If you don't return the costume, I will file for court.

  • Holding a commission slot three(3) separate times and failing to pay the invoice every time.

  • Cancelling a commission.

Warranty

  • There is a sixty day warranty on your costume that starts on the day that you receive it.

  • Any mistakes in sizing can be fixed, but the buyer must pay shipping both ways.

  • Any holes or errors in design can be fixed, but the buyer must pay shipping both ways.

  • Modifying, editing, or purposefully trying to destroy your costume in any way will cause your warranty to be voided.

  • Premade experimental products are not covered by my warranty. It will be clearly stated in the item description that your are purchasing an experimental item.

  • I offer free repairs for small issues such as holes or popped seams for free at any conventions or meet-ups I am attending. Please message me at least two days before so that I can bring the supplies needed.

We Will Not;

  • Make costumes for sexual use.

  • Craft copyrighted characters.

Shipping

  • I am not responsible for the product if the post offices loses or damages the item purchased and I am not required to issue a full or partial refund or remake the item if you choose not to insure the item for its full value.

  • Import duties, taxes, and charges not included in the item price of shipping cost are the buyer's responsibility.

Other​

  • I have the right to refuse service to anyone.

  • For those paying with payment plans, work will not be started on your costume until it has been fully paid off.

  • Please keep in mind that I am still learning and your costume may have some flaws.

  • I have three short-hair cats and a dog that frequently enter my workspace so if you have allergies please keep that in mind.

  • Quotes are only valid for one(1) month and don't include shipping.

  • Changes in character design after payment has been received may result in an up-charge if I see fit.

  • If I have not started your costume within six(6) months of the full payment you have the option to issue a full refund.

  • If the invoice is not paid within ten(10) days you forfeit your slot and may have to wait until I reopen for commissions.

  • It is the buyer's job to keep in contact with me. If possible, please provide me with your two most active emails and/or social media handles.

  • If you fail to contact me after one year(365 days), the design of your costume will be changed and the costume will be sold as a premade. You will be fully refunded once I can get a hold of you.

  • Do not sell my costumes, premade or commissioned, for a higher price than paid unless other items are included with the purchase. (Ex. Characters, art, and other costumes.)

  • You can post work in progress pictures that I send you, but make sure to tag or credit me in the post.

  • I will not make major changes to your costume without a fee after completion. I send multiple work in progress photos during the commission process. If you see something that you want changed, please let me know as soon as possible.
